August 8 Executive Order Does Not Ban Evictions

AUGUST 11, 2020 –

The August 8th Executive Order DOES NOT expand protections previously enacted by the CARES Act, stop evictions moving forward, or provide emergency rental assistance funding. Landlords can still seek to evict tenants—there is no national eviction moratorium. This means you can still be evicted for nonpayment of rent – even if the reason you cannot pay is related to the Covid-19 outbreak.

If you live in federally subsidized housing, or if your property has a government backed mortgage, your landlord must give you a 30 day notice of nonpayment before they can file an eviction against you.

If you have been served with a Notice to Leave the Premises and cannot pay rent due to the Covid-19 outbreak you may be eligible for rental assistance. Please reach out to the following agencies for rental assistance:
